Terms and conditions of sale COZIP

- Preamble
These general terms and conditions of sale (hereinafter referred to as the “Terms”) are concluded between:
On the one hand, COZIP, a company with a capital of 33,600 euros, registered with the RCS Lyon under number 533 399 008 00042, intra-Community VAT FR27 53339900800042 and headquartered at 662 rue des Jonchères, 69730 Genay, France (hereinafter referred to as "COZIP", "we" or "our"), and
On the other hand, individuals, consumers (hereinafter referred to as the “Customer(s)” or “you/your”), wishing to make a purchase via the online sales site: www.cozip.fr (hereinafter referred to as the “COZIP Site”).
COZIP and the Customers are hereinafter referred to as the «Parties».
COZIP sells its products exclusively remotely either via the Internet (on the COZIP Site or by email), or by telephone. COZIP does not distribute paper catalogues. - Purpose
These Terms are intended to define the terms of sale between COZIP and its Customers, from order to delivery.
Any difference according to the quality of the Customer, consumer or professional, are clearly mentioned in these Conditions.
3. Scope
These Terms govern the sale of products available on the COZIP Site on the day of placing the order by the Customer (hereinafter referred to as the «Products»). They apply to all methods of placing orders offered by COZIP, whether the order was placed on the COZIP Site, by email or by phone.
These Terms were last revised on 23/01/24. These Terms are subject to change at any time by COZIP. The Conditions applicable to the order placed by the Customer are those in force on the date of registration of the order. - Ordering Process
4.1 Conditions inherent to all orders
4.1.1 Ability to contract
Any Customer of the company COZIP declares to have the ability to contract under the conditions described below, that is to say to be a minor emancipated or have the legal majority and not be protected within the meaning of article 425 of the Civil Code.
COZIP reserves the right to refuse any order or order being processed by a Customer with whom it is in dispute, in particular a payment dispute.
4.1.2 Acceptance of the Conditions by the Customer
These Terms are available on the COZIP Site at https://www.cozip.fr/cgv.
At the Customer’s request, they may also be sent by e-mail. When buying online, the fact for the Customer to tick the box «I have read the general conditions of sale and I accept them» or, for any purchase by email, by phone or by post, to accept them before validating his order automatically implies the express acceptance by the latter and without restriction or reservation of these Conditions.
4.1.3 Characteristics of the Products
COZIP presents, on the technical sheets of the Products, the essential characteristics of the latter which the Customer must read. COZIP reserves the right to modify the assortment of Products according to the constraints related to its suppliers of raw materials. COZIP will make its best efforts to ensure that the photographic representation of the Products on the COZIP Site is as faithful as possible. It is nevertheless possible that the perception of the Product(s) does not fully correspond to the Product(s). The Products are presented in photography sometimes with other Product(s).
Unless otherwise specified on the COZIP Site, all Products sold by COZIP are new.
In any case, the Products comply with the legislation of the European Union in force and the standards applicable in France.
4.2 Availability of Products
COZIP works, depending on the Products, on the basis of just-in-time stock. Therefore, depending on the case, the Products are available within the limit of stocks available at COZIP.
The Products available in COZIP stocks for fast delivery are accompanied by the mention "Shipped within 24-48H" or "Scheduled Shipment on the Day/ Month". The availability of a Product may vary very quickly depending on sales. More specific information may be given to the Client by telephone or email.
Products unavailable in COZIP stocks may appear on the Site with the mention of a frame of the shipping time (for example: «within 1 week», «within 10 days», «within 15 days», «within 20 days», «between 2 and 6 weeks», etc.). This shipping time corresponds to the time required by COZIP to manufacture and ship the package to the Customer.
When a Product is mentioned «Product not available», the Customer cannot add it to his order basket, nor place the order. The Product will not be available for sale until we have manufactured it. However, it is possible to be notified of the date of new availability of the Products by sending an email to bonjour@cozip.fr.
When the Product is not in stock at COZIP, COZIP will inform the Customer of any delay in delivery in relation to the period mentioned on the Site, by email. This period being a guarantee of COZIP, the Customer will be entitled to request the cancellation of his order and to request his refund. The refund will be made as soon as possible and at the latest in accordance with the regulations within 14 days.
4.3 Placing the order
The Customer can place his order with COZIP either on the COZIP Site, by email, by phone or by post.
When the order is placed by e-mail or by post, the order must contain the information necessary to process it in good conditions.
In all cases, the identification of the Customer allowing the registration of the order must contain at least the following information:
- The Customer must identify himself by mentioning all the information usually requested for an online registration;
- The Customer must clearly identify the Products selected with the references indicated on the COZIP Site, references including color options, sizes, etc. In the case of Products with options, these precise references appear when the right options are selected;
- The Customer must also indicate the quantities requested;
- The Customer must also clearly indicate the information necessary for delivery. This applies in particular to the precise delivery address and any restrictions on the accessibility of the place of delivery (refer to the paragraph concerning deliveries);
- The Customer must indicate the chosen delivery method;
- Finally, the Customer must also indicate the chosen payment method.
4.4 Validation of the order
4.4.1 Conditions of order validation
The date of the order between COZIP and the Customer is deemed to be that of the email confirming the order of the Products. Indeed, an email is automatically sent to the Customer to confirm the order taking provided that the email address indicated in the registration form does not contain an error. COZIP does not send order confirmation by post or fax.
However, the contract will not be final until receipt by COZIP of the payment of the order by the Customer in accordance with article 4.4.2 below (hereinafter the «Order Date»).
Nevertheless, this Order Date is subject to the conditions related to the anti-fraud controls implemented by COZIP. If additional administrative documents are requested to ensure the identity of the originator of the order (see paragraph 4.6 “Controls to Prevent Fraud” below). In this case, the Order Date will be the later date between receipt of payment from the Customer and receipt of the requested documents.
The deadlines indicated on the COZIP Site run only from this Order Date described above.
4.4.2 Retention of title
COZIP remains the owner of the Products delivered until full payment by the Customer.
The above provisions do not prevent, upon delivery of the Products, the transfer to the Customer of the risks of loss or deterioration of the Products subject to retention of title and damage that they may cause.
4.5 Means of payment
The customer can pay his order:
- Online on the COZIP Website by credit card (credit card, Visa, Eurocard, Mastercard), ApplePay and Paypal. In this case, the Customer’s account will be debited for the amount of his purchases at the time of validation of his payment;
- By bank transfer (the data necessary for the transfer are provided on the site www.cozip.fr at the time of choosing the method of payment or may be provided to the Customer for other methods of order).
The Customer guarantees the company COZIP that he has the necessary authorizations to use the payment method chosen by him. COZIP reserves the right to suspend all order management and delivery in case of refusal of authorization of payment by credit card from officially accredited organizations or in case of non-payment.
COZIP has set up an order verification procedure to ensure that no person uses another person’s bank details without their knowledge. However, the consumer remains informed that COZIP cannot be held responsible for any malfeasance or fraudulent use of any means of payment that has not been detected by the verification procedure. As part of this verification and in accordance with Article 4.6 below, the Customer may be asked to send by email to COZIP a copy of an identity document and proof of address. The order will only be validated after receipt and verification by our services of the sent parts. In the absence of receipt of these parts within 14 days following the placing of the order, the latter will be deemed cancelled by operation of law. COZIP retains full ownership of the Products sold until full collection of all amounts due by the consumer in the context of his order, including fees and taxes.
4.6 Controls to prevent fraud
In order to prevent fraudulent use of payment methods, Customer accounts, delivery addresses, and to further secure Customer transactions, COZIP carries out controls on orders placed by its Customers.
As part of these checks, the Customer may be asked to send us administrative documents such as: Proof of identity and/or proof of address (fixed telephone bill, electricity, gas, water, etc.), and for companies: extract from KBIS less than 3 months old.
As part of these checks, if the supporting documents were not sent to us or if the documents sent did not establish with certainty the identity of the author of the order and the reality of the domiciliation, we could not validate the order and thethis would then be cancelled.
Refunds corresponding to these orders cannot be made without a number of checks necessary to identify the payer of the order. Thus, a payment by credit card will be refunded only and directly to the Customer’s credit card account.
4.7 Invoice
The order form that the Customer draws up online or the order confirmation sent by email to the Customer by COZIP does not serve as an invoice. Whatever the method of order and payment adopted, the Customer receives by email the original invoice. COZIP keeps an electronic copy of each invoice and the Customer can request it again at any time.
4.8 Late payment
In case of refusal by the bank of a debit card or other means of payment, it is up to the Customer to contact the customer service in order to settle his order by any means of payment.
4.9 Information provided when ordering
The Customer is responsible for the accuracy and completeness of the information in his Customer account and his order to ensure its proper processing. Thus, in particular, the address of the Customer and the delivery address of the order is under his full responsibility. COZIP cannot guarantee the consequences or be held responsible for additional delivery times, or additional delivery costs caused by an error in the information given by the Customer. The costs incurred by COZIP as a result of errors in the information provided by the Customer shall be borne by the Customer, in particular the costs of returning the order.
4.10 Price
The prices of the Products are indicated in euros, including all taxes and shipping costs. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the prices of the Products after the effective date of the new applicable rate. The VAT rate applied is as a percentage of the value of the goods sold and depends on the type of equipment purchased.
The prices of eco-participations are clearly indicated, separately and in accordance with the legislation in force in the Product sheets and in the order summary. These eco-participations are subject to the VAT applicable on the day of the order.
As the prices of COZIP’s raw material suppliers are constantly changing, the prices displayed on the sites are subject to change at any time. They are also subject to change due to introductory prices, promotions or sales.
In any case, the applicable price is that indicated on the COZIP Site on the date of registration of the order by the Customer.
4.11 Free port for metropolitan France Monaco and Corsica
For other countries, the shipping costs are charged to the Customer according to the weight of the package (packaging excluded), the place of delivery and the carrier or mode of transport chosen. They are subject to VAT at the rate applicable on the day of the order. They are indicated to the Customer before the final registration of the order. Shipping costs may be offered free of charge on an ad hoc basis as part of COZIP’s promotional marketing operations.
4.12 Discounts and Gifts
Only one individual discount (for example in the form of a promo code) can be granted per order. When purchasing a Product in multiple quantities, the discount applies only on the first copy, unless otherwise specified in the notice sent with the promotion or discount code. The same applies to the Products offered (only one gift or lot of gifts per Customer).
Gifts are offered according to the Product purchased. These gifts are listed on the pages of the Products in question or in the personalized offer sent to the Customer. Discounts, promotion codes, gifts, or vouchers are valid within the limits of the expiry dates mentioned either on the COZIP Website or in the email or email accompanying the description of the special offer.
If the Customer is entitled to gifts he must ensure that they are registered on the purchase order. If this is not the case, he must contact COZIP customer service. The Customer may not claim any reduction or compensation in the event that he refuses the gifts offered to him, COZIP taking charge of all the costs related to these gifts, including shipping costs.
Gifts are not taken back or exchanged.
5. Delivery
5.1 Timelines
Orders placed online via the COZIP Site are collected every morning from Monday to Friday. COZIP processes all orders recorded the day before up to the time of reading.
The preparation of an order can in principle last up to two working days including in particular the processing of the order, the preparation of the Products, the packaging and the invoicing before the shipment of the available Products, this preparation period taking effect on the Order Date. At the end of this period, COZIP sends the Product(s). An email is automatically sent to the Customer at the time of shipment of the Products provided that the email address indicated in the registration form is error-free.
COZIP informs its Customers that these deadlines do not include Sundays and holidays.
In case of partial unavailability of the Products, COZIP may be required to split shipments. Thus, the available Products may be shipped initially, the balance of the order being shipped when the other Products are available, without generating any additional cost for the Customer.
The Customer can ensure possible delivery days by contacting customer service by phone on +33 4 12 05 20 80 or by email at bonjour@cozip.fr. Indeed, the proposed delivery days may vary depending on the carrier and the region.
5.2 Packaging
The Products are packaged in such a way as to respect the transport standards in force, and to ensure optimal protection of the Products during their delivery. The Customer is asked to respect these same standards when returning a Product either during an after-sales service, or when returning for convenience. Any damage found to a Product on return due to a problem of level of packaging not respected may result in a partial refund or non-repayment of the Product in case of impossibility of resale in the state or in case of aggravation of the technical problem indicated.
5.3 Tracking the order
The Customer can at any time consult the status of his order on the COZIP Website by consulting his account. This tracking allows the Customer to know the processing status of his order, but also the shipping or delivery status of his packages. This last delivery tracking is done in interface with the Internet means of tracking carriers. COZIP cannot therefore be held responsible for unavailability, or errors that may affect the information provided by its carriers. Nevertheless, COZIP strives to make this information clearer and to make transport more reliable.
The Customer can at any time contact COZIP customer service to be informed of the follow-up of his order.
5.4 Abroad for heavy and/or bulky delivery
The information developed in this paragraph is valid for Germany, Belgium, Luxembourg, England, Italy, Switzerland and Spain.
From the start of your order from our logistics platform you will be informed by e-mail. The carrier will contact you within 7 working days to arrange an appointment for your delivery.
Deliveries are made from Monday to Friday on a half-day schedule.
Shipping costs are calculated based on the total weight of your order, its volume and your place of delivery. (It is therefore necessary to fill in the mandatory fields of the delivery address completely and without error).
Carriers are not required to deliver to you inside your home and are entitled to leave your package at the entrance of the building, or at the door of your home. We therefore advise you, as far as possible, to provide the help of a relative on the day of delivery, in case the driver cannot take the time to help you enter your package inside the home.
You are asked to sign the delivery note; if on receipt of the package you find that it is defective, we invite you to open the package in order to see in the presence of the carrier the condition of the Products inside and refuse the damaged goods.

For shipments outside the European Union, taxes are the responsibility of the recipient and will be requested at the time of delivery.
The invoice accompanies the package and a duplicate is sent to the Customer at the billing address.
Customs fees are paid at time of order.

5.6 Delivery of Heavy and/or Bulky Products
Please report any specific access problems (narrow street, access upstairs, pedestrian street...) when ordering a heavy and/or bulky product.
If you do not have an elevator or an internal staircase ready to transport the Bulky Product, the deliveryman will be free to deliver the Bulky Product to the ground floor of the place of delivery.
If the place of delivery of the bulky Product was not readily available to the deliveryman, so that the deliveryman would be forced to offer a second delivery or a delivery to a more accessible place, this second delivery would be charged to you.
5.7 Damaged Packages
The Customer must check the condition of the package before the carrier and issue the necessary reservations on the delivery note in case of apparent anomaly (partial or total deterioration of the package, damage, missing product compared to the delivery note, damaged package, broken products, etc.), the Customer or his representative must imperatively wear the delivery note of the SPECIFIC RESERVES: indication of the number of missing and/or damaged packages and detailed description of any damage (open or torn packaging, damaged or missing product, etc.). Imprecise formulations, such as "subject to unpacking" or "subject to verification" are worthless
In the absence of a reservation, the goods are deemed to be accepted by the Customer and may not be the subject of a dispute concerning their delivery.If the Customer makes reservations, he must confirm them by registered letter with acknowledgement of receipt sent to the carrier within 10 days, not including holidays, which follow that of delivery. It must notify COZIP’s customer service within the same period,, by email to bonjour@cozip.fr, so that COZIP can take the necessary measures to organize the return of the Product and a new delivery as soon as possible. In the absence of notification, COZIP cannot be held responsible for the length of the time taken in charge of the new delivery.
If a parcel sent by La Poste arrives open or damaged, the Customer must have a «statement of spoliation» (statement 170) drawn up by the deliveryman so that COZIP can open an investigation and a compensation procedure.
6. Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days.
The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the property.
If you have ordered several Products in a single order, or the delivery of the Products has been made in several parts, the withdrawal period does not begin until you, or a third party designated by you other than the carrier, physically take possession of the last Product or part of the delivery.
6.1 Exceptions to the right of withdrawal
The following Products may not be subject to the right of withdrawal:
The supply of Products made to specifications or clearly customized, or which, due to their nature, are likely to deteriorate or expire quickly. This exception includes mattresses with non-standard dimensions, a specific thickness or a specific shape.
6.2 Conditions for exercising the right of withdrawal and return
To exercise the right of withdrawal, the Customer must notify its decision to withdraw from these Terms by means of an unambiguous declaration to COZIP’s after-sales service, in particular:
By e-mail to bonjour@cozip.fr, or
By post to COZIP, 662 rue des Jonchères 69730 GENAY,
COZIP reserves the right to refuse a return under the right of withdrawal that would not have been notified to it.
6.3 Return and refund under the right of withdrawal
The right of return applies only to the extent that the Product is returned in perfect condition for resale, it being specified that the Client is liable only for the depreciation of the property resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of this property.
The return costs are the responsibility of the Customer. The Customer must return or return the goods to COZIP without undue delay and, in any event, no later than fourteen days after the Customer has communicated its decision to withdraw from this contract. This period is deemed to be respected if the Customer returns the property before the expiry of the fourteen-day period. If the property, due to its nature, cannot normally be returned by mail, the Customer will bear the direct costs of returning the property. These costs are estimated at a maximum of approximately EUR 495”
Ownership of the returned Products will be transferred to COZIP only when the Products arrive at the return destination. COZIP reserves the right to make a refund without requesting a return. In such a case, we will not become the owner of the returned Products.
In case of withdrawal from the Customer, COZIP will refund all payments received from the Customer, including delivery costs (with the exception of the additional costs arising from the fact that the Customer has chosen, where applicable, a mode of delivery other than the cheaper standard delivery method proposed) without undue delay and, in any event, no later than fourteen days from the day on which COZIP is informed of its decision to withdraw from this contract. COZIP will refund using the same means of payment used by the Customer for the initial transaction, unless the Customer expressly agrees to a different means; in any event, this refund will not incur any costs for the Customer.
COZIP may defer the refund until COZIP has received the good or until the Customer has provided proof of shipment of the good, the date being that of the first of these facts.
7. Guarantees
7.1 Contractual Guarantees
The duration of the contractual warranty of a Product is indicated in its Product sheet. The purchase invoice and the product warranty card are proof.
The duration of this contractual warranty and its conditions of application vary according to the Products.
In addition, the duration of the warranty and the related restrictions are indicated in the presentation sheet of the Product on the COZIP Site.
The Customer must keep the COZIP purchase invoice sent by email by COZIP during payment.
7.2 Legal Warranties
In addition to your contractual warranty under Section 7.1 of these Terms, you also have the option of returning Products that are found to be defective or non-compliant under the legal warranties.
Indeed, the Customers have the legal guarantee of conformity on all the Products, under the conditions provided for in articles L.217-4 and following of the Consumer Code, as well as the legal guarantee of hidden defects under the conditions provided for in articles 1641 to 1649 of the Civil Code.
Please note that when you act as a legal guarantee of conformity, (i) you have a period of two years from the delivery of the Product to act; (ii) you can choose between repair and replacement of the Product, subject to the cost conditions laid down in Article L211-9 of the French Consumer Code, (iii) you are exempt from providing proof of the existence of the lack of conformity of the Product during the 24 months following the issue of the Product and (iv) the legal guarantee of conformity applies independently of any commercial guarantee that may be granted. Finally, if you decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code, you can choose between the resolution of the sale or a reduction of the selling price in accordance with article 1644 of the Civil Code.
In the event that an amicable solution was sought prior to any legal action, we recall that this search does not interrupt the deadlines for bringing an action concerning this legal guarantee, nor the duration of specific and contractual guarantees.
Article L217-4 of the Consumer Code:
"The seller is obliged to deliver goods in accordance with the contract and is liable for defects in conformity existing at the time of delivery.
It shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation when the latter has been charged by the contract or carried out under its responsibility.”
Article L217-5 of the Consumer Code:
“The property complies with the contract:
1) If it is suitable for the usual use expected of a similar property and, if applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
- it has the qualities which a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling;
2) Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the knowledge of the seller and accepted by the seller.”
Article L217-12 of the Consumer Code:
“An action resulting from a failure to comply shall be barred after two years from the issue of the property.”
Article 1641 of the Civil Code:
“The seller is bound by the guarantee on account of hidden defects in the thing sold which render it unfit for the purpose for which it is intended, or which so diminish that use that the buyer would not have acquired it, or would have given it only a lesser price, if he had known them.”
Article 1648 of the Civil Code, paragraph 1:
"The action resulting from the defects must be brought by the purchaser within two years of the discovery of the defect."
- Responsibility
8.1 Force majeure
In the event of an event of force majeure, defined by article 1218 of the Civil Code as an event beyond the control of the debtor, which could not reasonably have been foreseen at the time of conclusion of the contract and whose effects cannot be avoided by appropriate measures, prevents the performance of its obligation by the debtor (such as fire, war, strike, natural disaster, etc.), which includes, within the meaning of these Conditions, a strike by a carrier slowing down or preventing the delivery of packages (hereinafter referred to as the «Force Majeure»), COZIP will use all means at its disposal to inform the Customer of the status of the shipment of his package.
However, in case of Force Majeure, COZIP can in no way be held responsible for delays and delivery problems caused.
8.2 Use of the Product
COZIP disclaims all liability for misuse or misuse of the Products ordered by the Customer.
8.3 Information presented on sites other than the COZIP Site
COZIP cannot be held responsible for information published on sites other than the COZIP Site. Links to third-party sites are provided for convenience only and do not imply any endorsement of their content.
- Tax
For all Products that the Customer intends to ship outside the European Union and DOM-TOM, obtaining an export sales slip from our services will allow him to begin the necessary steps to obtain the refund of the VAT rate of the Product or the corresponding order. If the Customer meets all the conditions required by the customs, he will have to make his request to obtain an export sales slip by email from our services and accompany it with a copy on both sides of an identity document (passport, identity card, consulate registration card, etc.). In the context of the relocation of an order or a Product to a country other than metropolitan France, we remind you that you remain the importer of the Product(s) concerned. Any customs duties, other local taxes, import duties or State taxes that may be payable shall not be the responsibility of COZIP. It is your sole responsibility to inquire with the local authorities and to assume responsibility for the corresponding declarations and payments with the competent authorities and bodies of the country concerned.
COZIP cannot be held liable for non-compliance with the legislation of the country where the Products will be delivered by the consumer. It is up to the consumer to check with the local authorities the possibilities of importing or using the Products or services he intends to transport, to ensure that their technical and operating specificities specific to the manufacturer comply with the legislation of the country concerned. - Full Terms
Should any provision of these Terms be declared invalid or unenforceable, the validity and enforceability of the remaining provisions of these Terms shall in no way be affected. Such an invalid or unenforceable provision shall be replaced by a valid or enforceable provision that is as close as possible to the effect of the invalid or unenforceable provision.
11. Jurisdiction and Applicable Law
These Terms are subject to French law. In the context of a dispute between the parties and following the failure of a written complaint from the Customer to COZIP’s customer service, or in the absence of a response from this service within a reasonable period of one (1) month, the Client may use any alternative dispute resolution method and in particular a mediation procedure by contacting the following mediator(s): [coordinates of the mediator(s) and his/their websites] or by accessing the European Online Dispute Resolution Platform at http://ec.europa.eu/odr which will attempt an amicable resolution and . In the absence of resolution of the dispute within the framework of this mediation, the dispute will be brought before the competent French courts.
